Mold Evaluation
Molds are pervasive fungi that, when found growing in spaces occupied by humans, usually cause concern. Fungi in buildings may cause or exacerbate allergic symptoms including wheezing, chest tightness, shortness of breath, nasal congestion, and eye irritation, especially in persons who have a history of allergic diseases (such as asthma and rhinitis).
Within the past few years, mold has become a media darling, garnering headlines as a result of million dollar claims. Less than a handful of states currently have legislation that addresses the quantification and remediation of mold, and there are no federal regulations. As a result of this lack of definitive regulatory or legislative guidance, remedies are left to the courts and juries. The issue that usually prompts the large claims is the lack of appropriate timely action by a responsible party, which could be the owner, the insurer, or the property manager.
